When a loved one passes away, having to deal with the administration of the Estate, including all the person’s legal and tax affairs, can understandably seem like a daunting task. This is particularly true at a time when you’re grieving. A lot of people are also particularly reluctant to take on the legal and financial responsibility for the work that’s involved as they would be personally responsible for rectifying any mistakes.

Probate is not always required (for example if all assets are held in joint names or if the estate is less than £5,000) but for the vast majority of estates it is required. Estate administration is necessary to complete whether or not a Will was in place, and can be very complex.
